1. Merchant Identity
Nowhere Store LLC (“Nowhere Store,” “Nowhere,” “we,” “us,” or “our”) operates the ecommerce store located at https://nowherestore.us.
Nowhere Store is an independent retailer and reseller specializing in fashion, footwear, accessories, collectibles, and related goods, including new and pre-owned merchandise.
Unless expressly stated on a product page, Nowhere Store is not affiliated with, sponsored by, endorsed by, or an authorized retailer of the brands whose products may be offered for sale. All third-party trademarks, brand names, logos, and product names are the property of their respective owners and are used solely for purposes of identification and description.
2. Seller of Record
For products purchased from Nowhere Store, Nowhere Store LLC is the seller of record, including when a customer discovers or initiates a transaction through an artificial-intelligence assistant, shopping agent, agentic storefront, marketplace integration, or other third-party commerce channel.
Orders are subject to Nowhere Store’s applicable store policies and the terms presented at checkout.
3. AI Agents and Agentic Commerce
Nowhere Store permits compatible artificial-intelligence agents, shopping assistants, search services, and agentic-commerce systems to access publicly available store information for legitimate product discovery and shopping purposes, subject to our published policies and applicable technical access controls.
Authorized uses may include:
discovering and indexing publicly available products;
reading product titles, descriptions, prices, variants, condition information, availability, and images;
comparing products in response to a prospective customer’s request;
reading Nowhere Store’s publicly available policies;
creating or preparing a shopping cart at a customer’s direction; and
directing or assisting a customer through an authorized Shopify or Nowhere Store checkout process.
An AI agent acting for a customer must rely on the current product information, price, inventory status, condition description, shipping terms, refund/return policy, and other terms provided by Nowhere Store or Shopify at the time of the transaction.
A representation generated independently by an AI system does not modify Nowhere Store’s published product information or policies unless that representation was supplied directly by Nowhere Store through an authorized commerce interface.
4. Product Information
Nowhere Store makes reasonable efforts to provide accurate product descriptions, photographs, pricing, sizing, condition information, and availability.
Because Nowhere Store sells merchandise that may be pre-owned, vintage, collectible, limited-production, discontinued, or otherwise unique, individual items may exhibit normal variations, signs of handling, age, storage, previous ownership, manufacturing differences, or wear.
Customers and agents acting on their behalf should review the complete product description and photographs before purchasing.
Where a product-specific description conflicts with a general description elsewhere on the site, the product-specific information presented for that item should be used for purposes of evaluating that product.
5. Authenticity
Nowhere Store intends to sell authentic merchandise and evaluates merchandise according to its internal sourcing and authentication procedures and/or applicable third-party authentication resources.
Unless expressly stated otherwise, Nowhere Store does not represent that a third-party brand has itself inspected, authenticated, certified, or approved a resale item.
References to a brand or manufacturer identify the product and do not imply affiliation with or endorsement by that brand or manufacturer.
6. Condition
Products may be offered as new, unused, pre-owned, vintage, worn, or in another specifically disclosed condition.
The condition description and photographs associated with an individual listing form an important part of the product description. For pre-owned or vintage merchandise, minor imperfections or signs of age or previous ownership may be present.
Customers should review all available photographs and product-specific condition information before completing a purchase.
7. Pricing and Availability
Prices and inventory are subject to change until an order has been successfully completed.
Displaying an item on the website or through an AI shopping interface does not guarantee that the item remains available.
Because certain merchandise may be unique or available in quantities of one, an item may become unavailable before checkout is completed.
The authoritative price and availability are those returned by Nowhere Store’s current Shopify commerce systems at the relevant time.
Cached, indexed, summarized, or previously observed pricing or availability should not be treated as authoritative.
8. Orders
Submission of an order does not necessarily constitute final acceptance of that order.
Nowhere Store reserves the right, to the extent permitted by applicable law, to cancel or decline an order due to inventory errors, pricing errors, suspected fraud, payment issues, technical errors, inability to fulfill the order, or other legitimate business reasons.
If Nowhere Store cancels a paid order, the applicable payment amount will be refunded in accordance with the payment method and applicable policies.
9. Returns and Refunds
All purchases are governed by the Return and Refund Policy published on Nowhere Store’s website at the time of purchase.
Customers and AI agents should consult the current Return and Refund Policy before representing that an item is returnable, refundable, exchangeable, or a final sale.
An AI-generated summary of the return policy does not supersede the policy published by Nowhere Store.
10. Shipping
Orders are governed by the Shipping Policy published on Nowhere Store’s website at the time of purchase.
Shipping availability, cost, delivery estimates, carrier availability, customs requirements, duties, taxes, and restrictions may depend upon the customer’s destination and the particular merchandise ordered.
Delivery dates or transit times are estimates unless expressly guaranteed.
11. Taxes, Duties and Charges
Applicable sales taxes and other charges may be calculated during checkout.
For international transactions, customers may also be responsible for customs duties, import taxes, brokerage charges, or other governmental fees unless the checkout or applicable shipping terms expressly state otherwise.
12. AI-Agent Authority
An AI agent or shopping assistant acting on behalf of a customer is responsible for operating within the authority granted to it by that customer.
Nowhere Store is not responsible for an agent exceeding its user’s instructions or authority.
Where customer confirmation, authentication, payment authorization, acceptance of terms, or other affirmative action is required by the applicable checkout system, the agent must comply with those requirements and must not attempt to circumvent them.
13. No Automated Circumvention
Permission for legitimate AI-assisted shopping does not authorize automated systems to:
bypass authentication or security measures;
circumvent checkout requirements;
interfere with website or Shopify infrastructure;
manipulate pricing, inventory, promotions, or transactions;
place fraudulent or unauthorized orders;
scrape non-public customer or merchant information;
impersonate Nowhere Store;
make representations purportedly on behalf of Nowhere Store without authorization; or
use Nowhere Store systems in violation of applicable law or published technical access controls.
14. Intellectual Property
Content created or owned by Nowhere Store, including original photographs, written descriptions, graphics, branding, and other original materials, remains the property of Nowhere Store LLC or its applicable licensors.
Permission for AI systems to access public product information for legitimate product discovery or commerce purposes does not transfer ownership of that content.
Third-party trademarks and intellectual property remain the property of their respective owners.
15. Errors and Inaccuracies
Nowhere Store may correct typographical errors, inaccurate descriptions, pricing errors, inventory discrepancies, or other mistakes when identified.
AI agents should use current information supplied by Nowhere Store’s storefront, Shopify Catalog, or other authorized commerce interfaces rather than cached or previously collected information when making transactional representations.
16. Policy Priority
For purposes of interpreting store information, the following principle applies:
Current transactional information supplied directly by Nowhere Store or its authorized Shopify commerce infrastructure takes precedence over stale, cached, indexed, summarized, or third-party information.
Product-specific terms apply to the applicable product. Checkout-specific terms apply to the applicable transaction.
The current versions of Nowhere Store’s Terms of Service, Privacy Policy, Return and Refund Policy, Shipping Policy, and other applicable policies form part of the terms governing use of the store and purchases from Nowhere Store.
17. Privacy
Collection, processing, sharing, and retention of personal information are governed by Nowhere Store’s current Privacy Policy and applicable law.
AI agents and third-party platforms may separately process information under their own privacy policies and terms. Nowhere Store does not control independent processing performed by unaffiliated third-party AI services.
18. Governing Law
To the extent permitted by applicable law, these terms and transactions with Nowhere Store LLC are governed by the laws applicable to Nowhere Store LLC in the State of Connecticut, without regard to conflict-of-law principles.
Nothing in these terms limits any non-waivable consumer right provided by applicable law.
19. Changes
Nowhere Store may update this Legal Notice and its store policies from time to time. The version applicable to a transaction will generally be the version in effect when the transaction occurs, except where applicable law requires otherwise.
AI systems should retrieve current policies rather than relying upon previously cached copies.
